A class action lawsuit has been filed on behalf of victims, including the Chengs, who had $42,825 seized without any specific violation of Indiana law. The lawsuit asserts that the police seizures violate the US Constitution's guarantees of due process and the Indiana Constitution's prohibition against prosecuting alleged crimes that occur outside Indiana. The Chengs' money was returned seven months after it was seized, but the lawsuit will continue to bar the state of Indiana and Marion County prosecutor Ryan Mears from initiating currency forfeitures.
