A federal judge has terminated the preservation order mandating OpenAI to retain its ChatGPT data indefinitely. This decision, issued on October 9th, frees OpenAI from preserving all future output log data. The initial order stemmed from a December 2023 lawsuit by the New York Times, accusing OpenAI of copyright infringement. The NYT claimed OpenAI used its copyrighted content to train its AI models without permission.In May, OpenAI was instructed to keep all chat logs for the NYT to analyze copyright violation claims. OpenAI appealed, arguing the preservation order was excessive and threatened user privacy. This new order nullifies the data preservation obligation for logs created after September 26th. Pre-existing saved chat logs will remain accessible to the NYT.OpenAI must also continue to retain data linked to ChatGPT accounts flagged by the NYT. The NYT is permitted to increase the number of flagged users as it continues to examine the preserved records. This ensures the Times can continue its investigation despite the order's general termination. The court’s decision provides a balance between the legal demands and OpenAI’s operational needs.
