Official statistics from the Basque regional police, Ertzaintza, reveal a disproportionate number of foreign-born individuals in crime arrests. In the first half of 2026, foreign-born individuals, who constitute 10.2 percent of the population, accounted for 58.7 percent of all arrests. This disparity is particularly pronounced in severe offense categories. For instance, 74 percent of arrests for crimes against sexual freedom and 73.3 percent of homicide arrests involved foreign-born suspects. They also accounted for 94.7 percent of drunk-driving arrests, 79.6 percent of theft arrests, and 77.6 percent of violent robberies. The Basque Department of Security began systematically publishing this data in late 2025 due to pressure from political parties like the Popular Party and Vox. Security councillor Bingen Zupiria stated this change allows for greater transparency and crime prevention. Within the foreign-born group, individuals from North Africa are particularly over-represented, despite making up only 1.8 percent of the population. They accounted for 37 percent of homicide arrests and 24 percent of sexual assault arrests. Overall arrests in the Basque Country have been increasing significantly, with a projected record of 10,100 arrests for 2026. Similar trends are observed across Spain, where an internal document indicated foreigners accounted for 51 percent of daily arrests. Other research suggests foreigners commit significantly more rapes and murders than Spaniards. Basque prison data further supports this, with foreign-born individuals making up 36.7 percent of inmates and an even higher 65.9 percent among those under 25.
