California's age-verification bill, AB 1856, has passed its legislature with an open-source carve-out remaining intact. The bill now moves to Engrossing and Enrolling before reaching Governor Gavin Newsom. It mandates age verification for covered operating systems, building on the Digital Age Assurance Act taking effect January 1, 2027. Operating systems with account setup features must prompt users for their birth date, age, or both. This information is then used to generate a digital age signal. The signal identifies users as under 13, 13-15, 16-17, or 18 and older, not revealing precise birth dates. This signal must be provided to covered application stores and developers via a real-time API. Application stores are required to request and make this signal available to developers. The open-source carve-out exempts such operating systems from these requirements.
