CFTC Lets Exchanges Convert Index Futures Into True Perpetual Contracts
CFTC staff has granted temporary no-action relief, permitting designated contract markets to transform specific broad-based security index futures into perpetual contracts. Exchanges can eliminate expiration dates for these contracts if they adhere to customer protection, notice, and filing requirements. This relief is narrowly focused, applicable only to existing qualifying contracts. It will expire on October 20th, offering a limited window for these changes. The U.S. derivatives market is thus moving closer to a contract structure familiar to crypto traders, the true perpetual future. The CFTC's Division of Market Oversight announced this development on October 5th. Exchanges must undertake specific steps, including soliciting participant feedback and providing advance notice, before conversion. Customers must be given an opportunity to exit their positions with appropriate risk disclosures. The relief does not allow exchanges to alter other material contract terms. This temporary relief signifies the CFTC's increasing comfort with the perpetual contract structure. It allows regulated U.S. exchanges to test perpetual index futures under defined customer protection conditions.
