The case centers on allegations that Elsevier published a manipulated study about air purifying technology despite objections from peer reviewers. Global Plasma Solutions (GPS), the company behind the technology, claims Elsevier's actions led to substantial financial losses. GPS sued Elsevier in 2022 after the publisher refused to retract the 2021 paper in Building and Environment. The lawsuit asserts that Elsevier knowingly published a study with omitted data and misleading conclusions. GPS argues that Elsevier published the article even though it failed their own peer review standards. A judge previously sanctioned Elsevier $10,000 in this ongoing case. The lawsuit survived Elsevier's motion to dismiss, with a magistrate judge finding GPS had plausibly alleged "actual malice." This finding was later upheld by the Chief Judge. GPS further alleges that internal documents reveal Elsevier has published over 1,200 articles without adequate peer review.
