ESMA consults on transparency requirements for derivatives under MiFIR Review
The European Securities and Markets Authority (ESMA) is seeking input on proposals for Regulatory Technical Standards (RTS) on transparency requirements for derivatives, amendments to RTS on package orders, and RTS on input/output data for the over-the-counter (OTC) derivatives consolidated tape. This consultation is part of the Market in Financial Instruments Regulation (MiFIR) Review. The proposals cover transparency requirements for derivatives, including the new deferral regime for Exchange Traded Derivatives (ETD) and OTC derivatives, and amendments to pre-trade waivers and post-transparency fields and flags. The consultation also addresses RTS on package orders, considering the new scope and liquidity determination for derivatives. Additionally, ESMA is seeking input on RTS on input/output data for the OTC derivatives consolidated tape, including data quality requirements for consolidated tape providers and data contributors. The consultation will remain open until July 3, 2025. Based on the feedback received, ESMA will publish a final report and submit the draft technical standards to the European Commission in Q4 2025. The consultation paper is part of the MiFIR Review Consultation Package 4. ESMA is developing various technical standards to further specify certain provisions set out in the MiFIR Review. The consultation is open to all stakeholders, and ESMA encourages feedback from market participants, industry associations, and other interested parties.
