ESMA publishes technical standards on CCP admission criteria elements

The European Securities and Markets Authority (ESMA) has released its Final Report on Regulatory Technical Standards (RTS) regarding central counterparties' (CCPs) admission criteria. These RTS are a result of the review of EMIR 3, which amended rules on participation in CCPs, including for non-financial counterparties (NFCs). The standards outline the elements CCPs must consider when setting admission criteria for their clearing members. This includes guidance on aspects related to NFC clearing members and sponsored membership structures. It is important to note that the RTS do not prescribe specific admission criteria but rather the factors CCPs should take into account. ESMA engaged in a public consultation and held a hearing in late 2025 to gather feedback on the draft RTS. The final report incorporates the received feedback into its recommendations. The next step involves submitting these RTS to the European Commission for endorsement. Subsequently, the European Parliament and the Council will scrutinize them.
