FinCEN Withdraws Crypto Rules Targeting Mixers And Unhosted Wallets
FinCEN has withdrawn two proposed digital asset rules concerning unhosted wallet transactions and convertible virtual currency mixing. These proposals had been pending for years and would have introduced new reporting and recordkeeping obligations for financial institutions. The withdrawal means these specific proposals will not be implemented in their current form. However, existing Anti-Money Laundering (AML) and Know Your Customer (KYC) rules still apply to regulated cryptocurrency businesses. FinCEN considered public comments received before deciding to withdraw the proposals. The agency stated this move is part of an effort to improve digital asset regulation. While financial surveillance has not been eliminated, these particular rule proposals are no longer progressing. Regulated entities like exchanges and banks must continue to adhere to current AML and sanctions regulations. The withdrawal removes two sources of criticism regarding privacy and implementation of the proposed rules. This provides the industry with a clearer policy landscape. FinCEN or Congress could still address these issues through future rulemaking. For now, the termination of these pending proposals represents a significant procedural change. Companies can now adjust their planning, no longer needing to prepare for these specific reporting frameworks.
