A federal judge has allowed Dr. Meryl Nass's lawsuit against the Maine Board of Licensure in Medicine to proceed. The judge stated that the board's order for a psychological evaluation was made without sufficient evidence or proper process. This evaluation was mandated after Nass allegedly spread misinformation about COVID-19. The board also took issue with her prescribing ivermectin and her explanation for hydroxychloroquine use. Nass believes her license suspension was based on her opinions rather than actual inability to practice medicine. State law permits psychological evaluations only for demonstrable mental or physical conditions affecting medical practice. The judge noted the board's actions lacked safeguards against overreach and may have been influenced by Nass's dissenting opinions. Previously, a state court had voided the psychological evaluation order as arbitrary and capricious. While the board's members have immunity for other actions, the psychological evaluation order remains a point of contention in the federal case. Nass's license is suspended because the board imposed conditions she found unacceptable, preventing her from practicing according to her judgment.
