SCOTUS rejects Trump's birthright citizenship policy

The Supreme Court has struck down President Trump's executive order that aimed to restrict birthright citizenship. This decision upholds the long-standing principle that anyone born on U.S. soil is an American citizen. The ruling is a significant setback for Trump's immigration agenda. Chief Justice John Roberts stated that children born in the U.S. to parents, even those present unlawfully or temporarily, are subject to U.S. jurisdiction and are citizens at birth. Justice Clarence Thomas, in his dissent, argued that the Civil Rights Act and the Citizenship Clause guaranteed citizenship to those born and domiciled in the U.S., irrespective of race. Had the order succeeded, millions of children could have lost eligibility for citizenship, potentially becoming stateless. Former President Trump had publicly expressed dissatisfaction with Justices Gorsuch and Barrett regarding this issue. His executive order proposed limiting birthright citizenship to individuals with at least one legally present parent. This challenged the interpretation of the 14th Amendment's Citizenship Clause. The majority of justices seemed unconvinced by the administration's arguments during oral arguments.
