Sixth Circuit Throws Out DOJ Misconduct Complaint Against Judge Boasberg

The Sixth Circuit Court of Appeals has dismissed a Department of Justice misconduct complaint against U.S. District Judge James Boasberg. The complaint stemmed from alleged remarks Boasberg made at a Judicial Conference, where he reportedly warned Chief Justice John Roberts about the Trump administration's intent to disregard court rulings and provoke a constitutional crisis. The Trump administration argued these comments violated judicial ethics. Additionally, a prior ruling by Boasberg blocking the deportation of Venezuelan nationals to El Salvador's CECOT prison fueled accusations of ideological bias. Sixth Circuit Chief Judge Jeffrey S. Sutton dismissed the complaint, stating the government provided no credible evidence of Boasberg's alleged comments. Sutton emphasized that the allegations lacked corroboration and that candid discussions among federal judicial leaders are a core function of the Judicial Conference. He also noted that the Chief Justice's own report on judicial independence validated similar concerns. The White House expressed dissatisfaction with the ruling, labeling some judges as "left-wing, activist" and undermining the rule of law. A White House official argued that such judges are shaping policy rather than interpreting law. Despite the dismissal, Judge Boasberg may still face other challenges, including potential impeachment proceedings. Senator Ted Cruz had previously called for impeachment proceedings against Boasberg over his past rulings.
